Subscription and Refund Policy

This Subscription and Refund Policy (“Policy”) explains the rules that apply to subscriptions, billing, renewals, cancellations, and refunds for DearMelodies and our related websites, applications, online platforms, digital products, services, account features, subscription features, content, and related systems.
This Policy forms part of, and should be read together with, our Terms of Service. Capitalized terms used but not defined in this Policy have the meanings given to them in the Terms of Service.
1. Subscription plans
1.1. Some or all of the Services may be offered on a paid subscription basis. When you purchase a subscription, you must select one of the subscription plans made available at the time of purchase.
1.2. Subscription plans may vary by price, duration, included features, credits, usage limits, trial period, introductory offer, promotional discount, renewal period, or other conditions. The applicable subscription terms will be shown before you complete your purchase and may also be confirmed by email, invoice, receipt, account page, checkout page, or other purchase confirmation.
1.3. By selecting and purchasing a subscription plan, you agree to the price, billing frequency, subscription period, renewal terms, cancellation rules, refund rules, and other conditions disclosed to you at checkout or in the relevant offer.
1.4. By purchasing a subscription or any digital content or digital service, you expressly request and consent to immediate access to and performance of the digital content or digital services. You acknowledge and agree that, once the digital content or digital services are made available, accessed, generated, customized, downloaded, streamed, or otherwise supplied, you may lose any statutory withdrawal, cancellation, or cooling-off right to the extent permitted by applicable law. Where required by applicable law, the checkout flow or purchase process may also ask you to confirm this request, consent, and acknowledgment separately before completing your purchase.
2. Initial prices, regular prices, and promotions
2.1. We may offer introductory prices, promotional prices, discounts, free trials, paid trials, or reduced-price access for a limited period. In this Policy, any reduced-price or promotional period is referred to as the “Initial Phase.”
2.2. After the Initial Phase ends, your subscription will continue at the then-applicable regular price unless you cancel before the next billing date. In this Policy, the period charged at the non-promotional price is referred to as the “Regular Phase.”
2.3. If no Initial Phase applies, your subscription will begin in the Regular Phase.
2.4. Before completing your purchase, you are responsible for reviewing the subscription terms, including the Initial Phase price, the Regular Phase price, the subscription period, the renewal period, and the cancellation rules.
For example, if you purchase a subscription with a three-month Initial Phase at a reduced price, you will be charged the reduced price for the first three months. Unless you cancel before renewal, your subscription will then renew for the applicable renewal period at the Regular Phase disclosed to you.
3. Automatic renewal
3.1. Unless stated otherwise at checkout or in the applicable offer, subscriptions automatically renew at the end of each subscription period (subscription up to 4 weeks auto-renew to 1 month or 4 weeks subscription period) until canceled. Usually offered subscription periods are 1 week or up to 4 weeks, 1 month, 2 month, 3 month (or equivalent monthly subscriptions to weekly) or other.
3.2. By purchasing a subscription, you authorize us and/or our payment processors to charge your selected payment method for recurring subscription fees, taxes, and other applicable charges at the billing frequency disclosed to you.
3.3. Renewals generally occur for the same duration as the previous paid subscription period, unless the applicable offer states otherwise. For example, if you purchase a three-month subscription, the subscription may renew every three months unless canceled before the next billing date.
3.4. The number of renewals is not limited unless the applicable offer states otherwise. Your subscription will continue until you cancel it or until we suspend or terminate it in accordance with the Terms of Service.
4. Billing
4.1. You will be charged at the time of purchase and then at the start of each renewal period unless you cancel before the next billing date.
4.2. The charge will be made using the payment method you selected or any updated payment method you provide. If your payment method fails, expires, has insufficient funds, or is otherwise unavailable, we or our payment processors may attempt to process the payment again. We may also suspend or limit access to the Services until payment is completed.
4.3. The exact billing date may vary due to payment processing times, failed payment attempts, changes to your payment method, time zones, non-business days, bank processing rules, or other operational reasons.
4.4. You are responsible for ensuring that your payment information remains accurate and up to date.
5. Subscription features, credits, and usage limits
5.1. Subscription plans may include access to certain features, usage limits, credits, digital content, tools, outputs, or other benefits. Unless the applicable offer states otherwise, any features, credits, or benefits included in a subscription are available only during the relevant subscription period and do not carry over after the subscription period ends.
5.2. Unused features, credits, or benefits may expire at the end of the period for which they are provided. Some subscription plans may provide credits or benefits in smaller intervals within the subscription period. For example, if you purchase a 3-month subscription that includes 15 credits, those credits may be made available as 5 credits per month, rather than all 15 credits at once. Any unused monthly credits may expire at the end of that month and may not carry over to the next month or renewal period, unless the applicable offer states otherwise.
5.3. We may offer upgrades, add-ons, one-time purchases, lifetime access, extended access, or other promotional options. Any such offer will be subject to the specific terms shown at the time of purchase.
6. Cancellation
6.1. You may cancel your subscription at any time using the cancellation method made available in your account, on the checkout platform, through the relevant app store or payment provider, or by contacting us through the “Contact / Contact us” section or via email hello@dearmelodies.com
6.2. To avoid being charged for the next subscription period, you must cancel before the next billing date - at least 48 hours before the next scheduled billing date.
6.3. If you cancel after a renewal charge has already been processed, the cancellation will apply to the next subscription period unless applicable law requires otherwise or we decide to provide a refund under this Policy.
6.4. Cancellation stops future renewals. It does not automatically provide a refund for amounts already paid.
6.5. After cancellation, you may continue to access the paid Services until the end of the subscription period you have already paid for, unless your access is terminated earlier under the Terms of Service.
7. Refund policy
7.1. Because the Services are digital services and are made available immediately after purchase, all payments are generally final and non-refundable, except as required by applicable law or as expressly stated in this Policy or in the specific offer presented to you at checkout.
7.2. We do not provide refunds for:
- partial use of a subscription period;
- unused time, features, credits, outputs, or benefits;
- failure to cancel before renewal;
- changes in your personal circumstances;
- dissatisfaction where the Services were provided as described; or
- accidental purchases, except where applicable law requires otherwise or we decide otherwise at our discretion.
7.3. We may provide a refund, in full or in part, where:
- a refund is required by applicable law;
- the Services were not provided due to our fault;
- the applicable offer or promotional campaign expressly included a refund right;
- a duplicate charge, billing error, or unauthorized charge is confirmed; or
- we determine, in our sole discretion, that a refund is reasonable and appropriate in the circumstances.
7.4. Refunds are not guaranteed and are assessed on a case-by-case basis.
8. Digital services and consumer rights
8.1. Nothing in this Policy limits any mandatory consumer rights that cannot be excluded under applicable law.
8.2. Where applicable law gives you a right to cancel or withdraw from a purchase of digital content or digital services, that right may not apply, or may be lost, once the digital content or digital service has been supplied, made available, accessed, streamed, downloaded, generated, customized, or otherwise started with your express consent or acknowledgment, where permitted by law.
8.3. By purchasing digital content or digital services and requesting immediate access, you acknowledge that we may begin performance immediately and that you may lose any applicable statutory withdrawal or cooling-off right once access begins or the digital content or digital service is supplied, generated, customized, made available, downloaded, streamed, or otherwise started, to the extent permitted by applicable law.
9. Price changes and plan changes
9.1. We may change subscription prices, features, billing periods, renewal terms, or available plans from time to time.
9.2. Where required by applicable law, we will provide notice of material changes before they take effect. If you do not agree to a change, you may cancel your subscription before the change applies.
9.3. Price changes will not affect a subscription period that has already been paid for, unless applicable law allows otherwise or you agree to the change.
10. Taxes and currency
10.1. Prices may exclude taxes, duties, levies, currency conversion fees, bank fees, app store fees, or payment provider fees unless stated otherwise.
10.2. You are responsible for any taxes or charges that apply to your purchase, except for taxes based on our income.
10.3. Where prices are shown in a particular currency, the final amount charged may vary depending on exchange rates, payment provider fees, bank fees, or taxes.
11. Purchases through third parties
11.1. If you purchase a subscription through an app store, payment provider, platform, reseller, distributor, or other third party, your purchase may also be subject to that third party’s terms, billing rules, cancellation process, and refund policy.
11.2. In such cases, you may need to cancel, manage, or request a refund directly through the third party from which you purchased the subscription. We are not responsible for delays, failures, or limitations caused by third-party payment, app store, platform, reseller, or distribution systems.
12. Contacting us about billing or refunds
12.1. If you believe that you were charged in error or that you are eligible for a refund under this Policy, please contact us using the “Contact / Contact us” section or by email at hello@dearmelodies.com.
12.2. Your request should include the email address associated with your account, the purchase date, the amount charged, the payment provider or app store used, and a brief explanation of the issue.
12.3. We may request reasonable information needed to identify the transaction and review your request.
13. Changes to this Subscription and Refund Policy
13.1. We may update this Policy from time to time. The updated version will be posted on our website, application, platform, or other appropriate location with a new “Last updated” date.
13.2. Your continued use of the Services after the updated Policy becomes available means that you accept the updated version, unless applicable law requires a different form of notice or consent.
