This Acceptable Use Policy explains the rules that apply when you access or use DearMelodies, including websites, applications, online platforms, digital products, services, account features, subscription features, content, customer support channels, and related systems.

This Acceptable Use Policy forms part of, and should be read together with, our Terms of Service. Capitalized terms used but not defined in this Acceptable Use Policy have the meanings given to them in the Terms of Service.

1. General rules

You agree to use the Services only in accordance with this Acceptable Use Policy, the Terms of Service, and all applicable laws and regulations.

When using the Services, you must:

  • provide accurate and truthful information where information is required;
  • keep your account credentials secure and not allow unauthorized access to your account;
  • use the Services only for lawful, personal, and permitted purposes;
  • respect the rights, privacy, safety, and dignity of others;

  • create, upload, submit, generate, distribute, or promote content that is unlawful, hateful, abusive, threatening, defamatory, obscene, pornographic, sexually exploitative, or otherwise objectionable;
  • create, upload, submit, generate, distribute, or promote content involving the sexual exploitation or abuse of minors, or any content that endangers, targets, grooms, exploits, or harms minors;
  • promote, support, finance, glorify, or provide instructions for terrorism, violent extremism, organized crime, self-harm, suicide, physical harm, or the manufacture or use of weapons, explosives, or other dangerous materials;
  • publish, share, or request private, confidential, financial, medical, authentication, payment, account-access, or identity information of another person without authorization;
  • violate, misappropriate, or infringe any intellectual property, privacy, publicity, confidentiality, or other rights of the Company or any third party;
  • generate or distribute false, misleading, deceptive, manipulated, or impersonating content in a way that may cause harm, confusion, fraud, or misrepresentation;
  • engage in phishing, spoofing, social engineering, scams, fake reviews, fake engagement, romance scams, click fraud, ad fraud, or artificial traffic generation;
  • use the Services to develop, train, improve, operate, or support a competing product or service, except where expressly permitted by us in writing;
  • resell, sublicense, rent, lease, commercially exploit, scrape, copy, reproduce, or redistribute the Services, outputs, software, data, models, systems, or content except as expressly allowed by the Terms of Service;
  • bypass, disable, interfere with, overload, probe, scan, test, or circumvent any security, access-control, rate-limit, usage-limit, monitoring, or technical protection measure;
  • introduce, upload, transmit, or distribute viruses, malware, ransomware, spyware, worms, trojan horses, harmful code, or other malicious or disruptive software;
  • interfere with or disrupt the Services, servers, networks, systems, accounts, or devices of the Company, our service providers, other users, or third parties, including through denial-of-service or distributed denial-of-service attacks;
  • access or attempt to access any account, system, data, content, API, model, or feature without authorization;
  • reverse engineer, decompile, disassemble, copy, modify, or create derivative works of any part of the Services except where expressly permitted by applicable law; or
  • use automated systems, bots, scrapers, crawlers, or similar tools to access, extract, copy, monitor, or interact with the Services without our prior written permission.

3. User content and responsibility

You are solely responsible for the information, materials, prompts, files, photos, images, videos, text, data, communications, and other content that you upload, submit, generate, share, or otherwise make available through the Services.

You must ensure that you have all rights, permissions, consents, and legal authority necessary to upload, submit, generate, use, or share any content through the Services.

You must not upload, submit, generate, or share content that includes another person's image, voice, likeness, personal information, confidential information, or protected material unless you have the right to do so.

You acknowledge that outputs generated by or through the Services may not always be accurate, complete, reliable, appropriate, or suitable for your intended use. You are responsible for reviewing and evaluating any output before relying on it or using it.

4. Monitoring and enforcement

We may, but are not required to, monitor, review, investigate, remove, disable, restrict, or refuse access to any content, account, activity, or use of the Services if we believe that it violates this Acceptable Use Policy, the Terms of Service, applicable law, third-party rights, or the safety, security, integrity, or reputation of the Services.

We may cooperate with law enforcement authorities, regulators, courts, or third parties in connection with investigations or proceedings relating to your use of the Services.

5. Liability and indemnity

You are responsible for your use of the Services and for any consequences arising from your use of the Services, including any content you upload, submit, generate, share, or otherwise make available.

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the Company, its affiliates, and their respective directors, officers, employees, contractors, agents, service providers, licensors, and partners from and against any claims, demands, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

  • your violation of this Acceptable Use Policy;
  • your violation of the Terms of Service;
  • your violation of applicable law or third-party rights;
  • your content or use of content through the Services;
  • your misuse of the Services; or
  • your fraud, negligence, willful misconduct, or unauthorized activity.

This section applies in addition to any liability, limitation of liability, indemnity, or enforcement provisions in the Terms of Service.

6. Changes to this Acceptable Use Policy

We may update this Acceptable Use Policy from time to time. The updated version will be posted on our website, application, platform, or other appropriate location with a new Last updated date.

Your continued use of the Services after the updated Acceptable Use Policy becomes available means that you accept the updated version, unless applicable law requires a different form of notice or consent.
